Robert Kyagulanyi Ssentamu aka Bobi Wine singing partner together with his personal body guard Eddy Mutwe and other NUP supporters have died in their own movie after the high court in Kampala dismissed their application in which they sought to stop trial by the court Martial.
It should be remembered that this group was among the Kyagulanyi’s campaigning team which was arrested in Kalangala in December 2020 during the presidential general election open campaigns.
In Masaka they were granted bail but before leaving the Court yard, they were re-arrested by Military and then transferred to the General court martial in Makindye and charged with unlawful possession of ammunitions.
On Tuesday afternoon, Justice Nambayo Esta ruled that there’s nothing wrong for the group to be tried before the army court.
The judge ruled that since the group’s charges can be heard by the Army court so it is important that they get arraigned before the same court.
“Enough evidence has not been provided by these people to prove that they were tried by a competent court” said Justice Nambayo
Eddy Mutwe, Nubian Li and the 34 NUP supporters accuses the security personals for torturing them before, during and after the arrest.
Still accused government of violation of their rights when they were detained at Kasajjagirwa military.
“Kasajjagirwa not being a police detention centre doesn’t mean that it is not allowed by the law to retain civilians” she noted.
She also dismissed their claims of being denied access to their lawyers, medical doctors and relatives while in detention.
In their application, the group said that they has been detained beyond mandatory 48hours before being taken to court by the police and military.
“They were arrested on December 30th. 2020 which was a Wednesday and January 1. 2021 was a public holiday thus could not sit” Justice Nambayo responded to them.
Justice Nambayo with no delay dismissed the application without ordering for costs.
