Supreme Drama In Supreme Court as Justice Esther Kisakye Accuses CJ Owiny Dollo for Confiscating Her Minority Ruling File

Kampala: Today the Supreme Court sat in Kampala to read the detailed judgement in Kyagulanyi election petition withdrawal and the eight judges out of the nine who sits on the panel gave their ruling indicating that each party had to settles it’s own costs spent in the case. 

Then the supreme drama came in Supreme Court when it was a turn for Justice Esther Kisakye was her turn to read her minority ruling.

The Chief Justice Owiny Dollo and others wanted Justice Kisakye to read her ruling on a later date to which she did not agree with, and the drama started, public address system and power was switched off at the court premises as they  dissenting justice Esther Kisakye from delivering her ruling.

According to Justice Kisakye, on orders of Chief Justice Owiny-Dollo her file was confiscated.

“I’m here today to give my ruling in the recently withdrawn presidential petition… what is of surprise to me is that my file has apparently been confiscated on the orders of the chief justice” Justice Esther Kisakye of the Supreme Court on her minority ruling.

 “I felt it my constitutional duty to disobey the unlawful orders of the Chief Justice and to fulfil my duties as a member of this quorum,” Justice Esther Kisakye says. She adds that CJ Owiny-Dollo wanted her minority ruling to be read at a later date.

“When I was appointed a judge of this court in 2009, I took a judicial oath and swore to protect the Constitution of Uganda.” – Justice Esther Kisakye

Justice Esther went back to chambers and got the duplicate copy of her ruling such that she reads it.

“My file was confiscated by the chief justice. Nevertheless, I’m working with a duplicate copy,” Supreme Court judge Esther Kisakye as she returns to court to deliver her minority ruling in the now withdrawn election petition of Robert Kyagulanyi.
